For leasehold properties which share land and communal areas, such as
flats, there is also the option of owning a share of freehold. As the
name suggests, this means the owners of individual flats or apartments within a
building collectively own the freehold of the entire building but are still
bound by leasehold legislation.

However, there is also a lesser known third
option when it comes to property ownership: commonhold. Introduced in
2002 via the Commonhold
and Leasehold Reform Act, commonhold offers an alternative to the
traditional leasehold system when it comes to multi-occupancy developments,
aiming to provide homeowners with more control and ownership rights.

Understanding commonhold property
ownership

Commonhold ownership allows individuals to
own the freehold of their separate units within a building or development,
while collectively owning and managing the shared areas of the property such as
landings, stairways, walls, and the roof, through a ‘commonhold’ association.
This structure eliminates the concept of a separate freeholder, granting
homeowners greater autonomy over their property and communal spaces.

Unlike a leasehold property purchase,
commonhold ownership doesn’t expire after a set number of years either,
offering permanent ownership without the need for costly and time-consuming lease
extensions.

Key features of commonhold:

Perpetual ownership: There’s no lease term; you own your unit outright forever.

Collective management: Homeowners form a commonhold association responsible for managing and maintaining shared areas, ensuring decisions are made collectively and following standardised rules for commonhold.

No ground rent: Since there’s no separate freeholder, homeowners aren’t subject to ground rent charges.

Commonhold vs. Leasehold vs. Freehold

To appreciate the benefits of commonhold,
it’s essential to understand how it compares to leasehold ownership:

Leasehold: In a leasehold arrangement, you own the property for a fixed term, typically between 99 and 125 years, but it can be longer or shorter. As the lease term decreases, the property’s value can diminish, and extending the lease can be costly and complex. Leaseholders often pay ground rent and service charges, with limited control over how the building is managed. Disputes with freeholders over maintenance and costs are common.

Freehold: Freehold ownership means you own both the property and the land
it’s on indefinitely. This is straightforward for standalone houses but becomes
complex for flats, where shared spaces and structural elements require
collective management, which can have its challenges when a share of
freehold arrangement is in place, particularly since leasehold legislation
continues to apply. Currently, leaseholders of flats are only eligible to buy
the freehold (known as “freehold enfranchisement”) if at least 50 per cent of
owners in the building are on board. They must set up a limited company
together to own the freehold of the property jointly and cover the costs of any
maintenance.

Commonhold: This combines the
perpetual ownership benefits of freehold with a structured approach to
managing shared spaces, making it particularly suitable for flats and
apartments. Homeowners have a direct say in the management and maintenance
of communal areas through the commonhold association.

The push for commonhold and leasehold reform

The leasehold system has faced criticism
for years, with homeowners highlighting issues like escalating ground rents,
high service charges, and challenges in extending leases or purchasing
freeholds. In response, the UK government has been working towards
reforming property ownership laws to make them fairer and more transparent.

Recent developments:

Leasehold Reform (Ground Rent) Act 2022: This act, which came into force on 30 June 2022, aimed to tackle the issue of escalating ground rents by reducing them to a nominal “peppercorn” (essentially zero) rate for most new residential leases.

Leasehold and Freehold Reform Act 2024: This Act was introduced to provide greater rights and protections for leaseholders and became law in May 2024 under the previous Conservative Government. The current Labour Government published a statement and proposed timeline for implementation of the Act and further leasehold reform on 21 November 2024. Most recently (as of 1 February 2025), the Act has allowed leaseholders the right to extend their lease or buy the freehold of their property immediately after purchase rather than wait for the previous “two-year rule” to expire.

Government’s commitment to commonhold: In March 2025, the government published a white paper outlining plans to make commonhold the default system for new flats, effectively ending the traditional leasehold model for these properties. This move is part of a broader strategy to address the housing crisis by building 1.5 million homes over five years and ensuring homeowners have more control over their properties.

Easier conversion to commonhold: Recognising the challenges in converting existing leasehold properties to commonhold, the government plans to simplify the process. Proposed reforms include standardising rules, mandating reserve funds for maintenance, and strengthening governance within commonhold associations. These changes aim to make commonhold a more attractive and practical option for both developers and homeowners.

Challenges ahead

While the shift towards commonhold ownership
presents numerous benefits, there are still challenges to address:

Lengthy implementation of the Leasehold and Freehold Reform Act 2024 – The Government has said that implementation of the Act will require approximately 25-30 pieces of secondary legislation that will take years and not months to progress.

Retrofitting existing properties: Transitioning existing leasehold properties to commonhold can be complex, involving legal, financial, and logistical considerations. The government aims to streamline this process, but it will require cooperation from all parties involved.

Awareness and understanding: Many homeowners, developers, and lenders are unfamiliar with the commonhold system, leading to hesitancy in its adoption. Educational initiatives will be essential.

Management responsibilities: Commonhold requires active participation from homeowners in managing shared spaces. This collective responsibility can be daunting, especially in larger developments where consensus may be harder to achieve.

Looking forward

Whilst implementation is likely to be a
lengthy process, the move towards commonhold homeownership represents a
significant shift in UK property ownership, aiming to empower homeowners and
eliminate the pitfalls of the leasehold system.

You can find more information on its implementation
and timescales here: https://www.gov.uk/government/news/beginning-of-the-end-for-the-feudal-leasehold-system

Property ownership in the UK typically falls into two categories: freehold and leasehold.
