Unless you live in Scotland*<\/strong> – where it is the responsibility of the person who is selling the property to commission a home report prior to putting their home on the market – it is your responsibility to commission and pay for a survey on any property you are interested in buying. <\/p>\n\n\n\n

Whilst it is not a legal necessity to arrange a survey of a home you wish to buy, your legal counsel<\/a> will almost always recommend that you do so to avoid any costly maintenance issues coming to light at a later date during the conveyancing process or once you actually own the property. If you are buying the property with a mortgage<\/a>, your mortgage lender is also likely to want to see a survey report for the property, although they will usually also undertake their own, separate valuation report as well.\u00a0 <\/p>\n\n\n\n

You should commission a qualified, RICS<\/a> or RPSA<\/a> surveyor to undertake the survey once your offer has been accepted. You are able to request that a survey be undertaken for a property you are interested in purchasing at any stage, but the homeowner is under no obligation to let you undertake a survey until you have made an offer which they have formally agreed. You should always undertake the survey before you exchange contracts<\/a> though. This is because once contracts have been exchanged both the sale and offer price become legally binding. <\/p>\n\n\n\n

There are three\nmain types of homebuyer\u2019s survey in the UK. <\/p>\n\n\n\n

A condition\nreport<\/strong> \u2013 the most basic\noption, suitable for fairly new, standard build properties in good condition. It\nprovides an overview of the property\u2019s condition plus any risks, urgent defects\nor potential legal issues e.g. access rights.<\/p>\n\n\n\n

A homebuyer\nreport<\/strong> \u2013 the most\npopular survey, designed for standard build properties which are in a\nreasonable condition. In addition to the details of a condition report, the homebuyer\nreport also includes guidance on maintenance and repairs, plus any defects that\nmay have an impact at a later date.<\/p>\n\n\n\n

A full\nstructural survey (aka a building survey)<\/strong> \u2013 The most comprehensive survey.  Generally needed for larger properties aged 50\nyears plus and\/or those with an unusual layout or building materials,\nsignificant alterations, or in a bad state of repair. <\/p>\n\n\n\n

So, now you\nknow what a survey is and what it entails. Once the survey is completed though,\nis the seller<\/em> automatically entitled to a copy of the surveyor\u2019s report?\n<\/p>\n\n\n

Well, the short\nanswer is no, they are not. It is up to the buyer whether they wish to disclose\nthe results of the survey, despite what any pushy estate agent or conveyancer acting\nfor your seller may tell you!  <\/p>\n\n\n\n

When the\nsurveyor is undertaking the survey at the property, they are also not allowed\nto indicate the results of the survey to the seller, or what information the\nreport is likely to contain, without the knowledge or consent of the buyer who\nhas commissioned the survey.  This is\nalso the case for any valuations which are undertaken on behalf of the buyer,\nor their mortgage lender. <\/p>\n\n\n\n

However, there\nare likely to be instances where you will<\/em> wish to disclose all or part of\nthe survey results to your seller, particularly if you wish to renegotiate the\nprice you have offered due to any issues highlighted in the survey. <\/p>\n\n\n\n

If the survey has revealed unexpected issues that could have an impact on the property\u2019s value which the seller is either unaware of or has failed to disclose, you are within your rights as the buyer to renegotiate<\/a> the offer price. Once they have seen the survey report and\/or their own valuation report, your mortgage provider may also decide that the property\u2019s current value is less than your original offer price and decide to change the amount that they are willing to loan you to buy the property. <\/p>\n\n\n\n

If the buyer refuses to drop the price (and the sale is not dependant on tight timeframes) then you could always ask that any issues are rectified to an agreed upon standard by a set deadline as a proviso to you continuing with the sale at the original offer price. If the survey throws up any issues which should have been disclosed by the seller in the TA6 Property Information Form<\/a> or inaccurate information was knowingly provided, then as the buyer you may also be able to claim compensation or change your mind about buying the property. <\/p>\n\n\n\n

*A Scottish home report must consist of a property questionnaire completed by the seller and a survey and energy report (an <\/em>EPC<\/em><\/a>) which are prepared by a chartered surveyor. Sellers can be fined<\/a> \u00a3500 if<\/em> a property is marketed without a Home Report<\/em>. The seller must also provide an up-to-date home report within 9 days of a request from a credible potential buyer.<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"
