Going in on a new
home with a spouse, family member or friend – particularly if you are going to
be living in the property together – is a savvy way to take that first step on
the property ladder. Indeed, according to Halifax, the UK’s largest mortgage provider, the current
average age of first-time buyers in the UK is thirty-two, with an average
deposit of £53,935 for a property costing around £264,140. This is a whopping
seven times the average salary of a first-time buyer and just not an affordable
option for many.

In addition to
buying with someone else, you may also become the co-owner of a property if it
has been gifted to you, or you inherit it via the will of a family member or
friend.

So, whether you
buy, are gifted or inherit a property with someone else, what are your rights?

Below we run
through the different ways you can co-own a property (based primarily on a
50-50 split) and what these options mean in terms of your rights to the
property, what you can do with it and what happens when you decide to sell.

What are the
different types of property ownership for co-owners?

When you buy a
home with someone else, you can register with the Land Registry as either ‘joint tenants’ or ‘tenants
in common’. In Scotland, property is registered with the Registers
of Scotland and in Northern
Ireland the Land and Property Services.

The type of
ownership you choose affects what you can do with the property if your
relationship with a co-owner breaks down, or they pass away, so make sure you
consider all of your options and potential eventualities beforehand.

Joint
tenants

Registering
yourselves as ‘joint tenants’ – which is also referred to as ‘beneficial joint
tenants’ – means that you have equal rights to the entire property. If one
owner dies, the other owner is automatically granted full ownership of the
property and a percentage of the property cannot be left to someone else in the
diseased party’s will. As such, this type of ownership is the best option for
married couples or life partners rather than friends buying a home together.

Tenants in
common

If you register
the property ownership as ‘tenants in common’, this means you can own different
percentage shares of the property (useful if one of your stumps up more cash)
and if one owner dies, ownership does not automatically default to the other
owner (or owners). As such, you can also leave your share of the property to
someone else in your will.

Tenants in
common is generally the best way to register a property you buy with a friend
or family member rather than a spouse to give you more flexibility.

If a change in
circumstances – such as a divorce – means that you wish to change your
ownership arrangements from joint tenants to tenants in common (or vice versa) this can be done so free of charge by
applying to the Land Registry.

If you own a
property on your own and you wish to transfer ownership to someone else so that you are joint
tenants or tenants in common (such as a new partner who now lives in the
property with you and contributes to the household) this is also possible.

If you are
unsure about exactly the type of property ownership you or someone else has,
the title deeds for the property will display this information. If you do not
have the title deeds to hand, then you can purchase the title register for any registered property from the
Land Registry.

For properties
which have not been registered with the Land Registry and there are no title
deeds available, our guide “Can you sell a house without the deeds?” explains how to track down proof of
ownership. This could be the case for properties inherited from an elderly
relative for instance.

Inheriting a
property, or becoming a property trustee

When you
jointly inherit a property in someone’s will or it is gifted to you, you need
to register it with the Land Registry in the usual way.

There are also
instances where you may be asked to become a property trustee, which brings
with it certain rights and responsibilities when it comes to managing a home.

If you are
appointed as a trustee of a property by the
person who puts the property into the trust (the ‘Settlor’ or ‘Granter’ in
Scotland) this means that you must manage the property on behalf of the
beneficiary who is generally too young to manage their own affairs, an older
person requiring the provision of long-term care, or someone who does not have
the physical and/or mental capacity to manage their own affairs.

As trustee you
rights in terms of the property and what you can do with it only extend to acting
in the best interests of the beneficiary and these rights will be included in
the trust agreement. You are not able to benefit personally, financially or
otherwise, from the trust unless this is explicitly agreed in the trust
agreement.

More
information on the different types of trust and their implications for trustees
and beneficiaries can be found on the Government website here: https://www.gov.uk/trusts-taxes/types-of-trust

For properties
inherited directly or as a beneficiary of a trust
it is important to know that you are likely to be subject to tax. In this case, inheritance tax and capital gains tax.

What happens
when one or both co-owners want to sell the property?

If you both
want to sell, great, you would sell the property in the normal way and split
the proceeds according to the percentage of the property you own.

If one of you
wants to sell the property and the other doesn’t this can be trickier,
depending on the individual circumstances and whether the owner who doesn’t
want to sell can afford to buy out the owner who does.

If you and your
co-owners are tenants in common and each own a separate share of the property,
then you can pursue a sale by applying for an order for sale from the court. If you are joint
tenants then you will need to switch ownership from a joint tenancy to tenants in
common before you can apply for the order for sale. This is known as ‘severance
of joint tenancy’.

Regardless of
which option you choose to push the sale through then you will need to seek
legal advice. Particularly if you are selling the property with the intention
to divorce and need to assess all joint assets and consider custody and child
welfare arrangements.

In instances
where you wish to sell but the other owner no longer has the mental capacity to
make this decision you will need to apply to the Court of Protection to proceed if there is no Power of
Attorney in place.

Remember to
keep your mortgage lender in the loop and speak to a broker about the best way
to proceed if you have taken out a joint mortgage with your co-owner. There may
be early repayment fees depending on when you bought the property, and they
will also be able to provide information on mortgage options if one owner is
buying the other owner out of the property.

Are there
alternative options for parents wanting to help their children get onto the
property ladder without purchasing a property together?

If you want to
help your children get onto the property ladder but you don’t want to purchase
the property with them as joint owners there are other options.

Namely:

Contributing
a lump sum gift to help with the deposit and/or moving costs – Gifting money to your children now in
the form of a contribution to their house purchase is a savvy way to help them
purchase their dream home and avoid or reduce inheritance tax at a later
date, allowing you to give them financial assistance at a time when they really
need it. However, this is something you will need to think about and plan in
advance if you want to do so tax free as there is an annual tax-free gifting
limit.

A
loan – in the same vein
as a lump sum gift, although the repayments will need to be factored into any mortgage
affordability calculations by your children and it is also very important to
have a formal loan agreement in place so that all parties have the same
expectations.

An
offset mortgage – If
you have equity in your own property but not ready cash, you can borrow money
against your own property. It is important to be aware that this will be classed as a second
home, and you will therefore incur additional fees when purchasing.
