The date of transfer is either the date of death if the property\nwas still owned by the deceased person, or the date that it was gifted by them to\nsomeone else if this was <a href=\"https:\/\/www.gov.uk\/inheritance-tax\/gifts\">within\nseven years<\/a> of their death.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This valuation needs to take place because before\nprobate can be granted, <a href=\"https:\/\/www.gov.uk\/government\/organisations\/hm-revenue-customs\/contact\/probate-and-inheritance-tax-enquiries\">HMRC<\/a>\nneeds to assess the estate to see if it is liable for <a href=\"https:\/\/www.gov.uk\/inheritance-tax\">inheritance tax<\/a>. If inheritance\ntax <em>is<\/em> due, then this needs to be paid before probate is granted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You need to get a probate valuation even if\nthe beneficiaries do not wish to sell the inherited land or property since\ninheritance tax would still be applicable.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>What happens if the property\u2019s value changes\nbetween the date of transfer and the date it is sold? <\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Should the property be sold by the\nbeneficiaries for <em>less than <\/em>the probate value, then they will have paid\nmore inheritance tax than they were obliged to. Fortunately, there is a process\nfor reclaiming this money which is known as&nbsp;<a href=\"https:\/\/www.gov.uk\/government\/publications\/inheritance-tax-claim-for-relief-loss-on-sale-of-land-iht38\">inheritance\ntax relief<\/a>. &nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, it is important to note that this\ntax relief is only applicable when the sale of land or property has happened\nwithin four years of the deceased person\u2019s death and the claim for tax relief\nmust be submitted within 7 years of death.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If a property is sold for <em>more than<\/em>\nits probate value, the estate may be subject to <a href=\"https:\/\/www.yopa.co.uk\/homeowners-hub\/selling-inherited-property\/\">Capital\nGains Tax<\/a> (CGT) on the difference between the sale price and the probate\nvalue.
