Given that your home is generally your most valuable asset and will generate a lot of capital if sold or used to gain a mortgage, there are unscrupulous people out there who may try and take advantage of this fact by transferring the deeds (and therefore ownership) of your property into their own name or remortgaging your property without your consent. <\/p>\n\n\n\n

By fraudulently\ntransferring a property into a different name with the use of fake\ndocumentation, the property can then be sold without the real owner\u2019s knowledge\nor consent. Alternatively, similarly to other identity theft activities,\nfraudsters can change property records so that they are able to release equity\nfrom your home for their own benefit. <\/p>\n\n\n\n

When a home is owned\nmortgage free, rented out or left vacant it can be more susceptible to property\nfraud. It is also possible for anyone to find out whether or not this is the\ncase by checking the title deeds for said property via the HM Land Registry<\/a>. <\/p>\n\n\n\n

The HM Land Registry are\nresponsible for registering land and property across England and Wales (there\nare separate land registry organisations in Scotland<\/a>, Ireland<\/a> and Northern Ireland<\/a>) and it\nhas been compulsory to register any land or property sold since 1990 with the Land\nRegistry. The title register and title summary for a property registered with\nthe Land Registry provide information on the name and address of the property\nowner (where their address is not at the property in question), what they paid\nfor the property, whether it is freehold or leasehold<\/a> and\nwhether there is a current or \u2018discharged\u2019 (no longer applicable)\nmortgage.  <\/p>\n\n\n\n

So, how you do you protect\nyourself from property fraud? <\/strong><\/h3>\n\n\n\n

Thankfully, there are ways\nfor homeowners to protect themselves or a loved one from property fraud. <\/p>\n\n\n\n

First and foremost, ensure\nthat the title deed information the Land Registry holds for your property is\naccurate and up to date. If you \u2013 or an older relative \u2013 bought your property\nbefore 1990 then it may not be registered with the Land Registry. In which\ncase, you should arrange for the property to be registered<\/a> so there\nis an easy and cost effective way to provide proof of ownership. Once the Land Registry has\nthe up-to-date records for your property you can protect yourself further by\nsigning up to theirproperty alert service<\/strong><\/a>. You\nwill then receive an email alert whenever official searches and applications\nare received for the property in question. This means if anyone tries to make\nchanges to the register in relation to the property then you will be notified.\nThe service covers up to 10 properties per person, which can be helpful for\nlandlords who own and rent out multiple properties. You can also use the\nservice to monitor properties which you do not own, such as a relative\u2019s home,\nand more than one person can monitor a single property which can be useful for\nfamilies monitoring a property for a mutual loved one. However, it is important\nto note that the alert service will not prevent any updates being made to the\nregister, so you will need to follow this up directly with the Land Registry.<\/p>\n\n\n\n

You can also go one step\nfurther and register an anti-fraud restriction<\/strong><\/a> against\nyour property. This is registered on the title of the property and stops the\nLand Registry registering a sale or mortgage against the property unless a\nconveyancer or solicitor certifies the application was made by you as the\ncurrent owner. To do so costs \u00a340 for a property where you reside. It is free\nof charge for properties owned by businesses or owners who do not live at the\nproperty. A fee may also be incurred from your conveyancer or solicitor for the\ncertification.<\/p>\n\n\n\n

As a prospective buyer, if\nyou are purchasing a property which is not registered with the Land Registry,\nmake sure your vendor provides you with sufficient evidence<\/a> to confirm their ownership before any money changes hands. When\nyou begin your property search, you should also be wary of homes advertised on\nsocial media and online selling platforms like eBay or Gumtree where there is\nno guarantee of ownership or residential property status (whereby holiday or\ncommercial use properties are fraudulently marketed as permanent residences).\nOnly view properties marketed by reputable sources such as the online property\nportals Rightmove<\/a>, Zoopla<\/a> and OnTheMarket<\/a> or\nwell-regarded estate agents. When it comes to the completion of your purchase,\nalways ensure that you are using a trusted solicitor or\nconveyancer<\/a> who will ensure the secure transfer of\nfunds from your mortgage lender to the vendor\u2019s solicitor to avoid the risk of\nfraudsters intercepting the money.  <\/p>\n\n\n\n

As\na prospective vendor, be vigilant about the type of contract you sign with an\nestate agent so that you are not charged for a service which has not been\nprovided or end up paying commission twice. For instance, some agents may try\nto seek a fee from your property sale based on the continuing liability<\/a> of the contract that you signed with them, even if you\nsubsequently sell with a different agent. Seek out a reputable estate agent\n(such as Yopa<\/a>!)\nwho adheres to requirements from both HMRC<\/a> and the Property Ombudsman Code of Practice<\/a>.<\/p>\n\n\n\n

You\nshould also make sure you have done your research if you decide to sell your\nproperty to a \u2018quick sale\u2019 company, some of whom have been known to suddenly\ndrop their asking price once you are tied into the sale. And once you are at\nthe point of completing your sale, you should always ensure that you have the\ncleared funds in your account before handing over the keys and that you have used\na trusted conveyancer<\/a> to ensure your property was not purchased with the proceeds of\ncriminal or fraudulent activity. <\/p>\n\n\n\n

What do you do if you\nsuspect property fraud has taken place? <\/strong><\/h3>\n\n\n\n

If you think\nyou may have been a victim of property fraud via an unauthorised sale or\nmortgage you should contact the Land Registry\u2019s property fraud team immediately\nfor more specific advice on 0300 006 7030 between 08.30-12.00 and 13.30-15.30\nMonday to Friday or at reportafraud@landregistry.gov.uk<\/a>.<\/p>\n\n\n\n

You can also contact Action Fraud<\/a>, the\nUK\u2019s national reporting centre for fraud and cyber crime to report the crime\nand seek further advice.<\/p>\n\n\n
