{"id":2043,"date":"2021-02-25T13:37:30","date_gmt":"2021-02-25T13:37:30","guid":{"rendered":"https:\/\/www.yopa.co.uk\/homeowners-hub\/?p=2043"},"modified":"2021-02-25T22:26:25","modified_gmt":"2021-02-25T22:26:25","slug":"what-is-the-cladding-crisis","status":"publish","type":"post","link":"https:\/\/dy36-2.stage.yopa-dev.co.uk\/homeowners-hub\/what-is-the-cladding-crisis\/","title":{"rendered":"What is the cladding crisis?"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">When 72 lives\nwere lost in the wake of the <a href=\"https:\/\/www.bbc.co.uk\/news\/uk-40301289\">Grenfell\nTower<\/a> tragedy in the\nearly hours of 14 June 2017, a spotlight was shone on the issue of unsafe\nbuilding materials in blocks of flats and cladding in particular.&nbsp; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Grenfell Tower\nwas built in 1974 and similarly to a number of other newly built developments at\nthat time and in proceeding years, the tower included Aluminium Composite\nMaterial (ACM) cladding. This type of cladding has been found to be highly\ndangerous and combustible in nature and was a hugely contributing factor to the\nhigh death toll in June 2017. Cladding made from High Pressure Laminate (HPL)\nand Metal Composite Materials (MCM) has also become a cause for concern,\nparticularly as a result of a <a href=\"https:\/\/www.theguardian.com\/uk-news\/2019\/nov\/15\/fire-crews-battle-blaze-at-bolton-student-housing-building\">fire at a student accommodation\nblock<\/a>\nin Bolton, Greater Manchester in November 2019. &nbsp;Many failures have also been highlighted in\nthe regulation and compliance of the building industry as a whole via the <a href=\"https:\/\/www.grenfelltowerinquiry.org.uk\/\">Grenfell Tower Public Inquiry<\/a> and the <a href=\"https:\/\/assets.publishing.service.gov.uk\/government\/uploads\/system\/uploads\/attachment_data\/file\/707798\/Building_a_Safer_Future_-_print.pdf\">Independent Review of Building\nRegulations and Fire Safety<\/a> led by Dame Judith Hackitt.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There was much debate in the aftermath of the tragedy between the government,\ncontractors, builders and insurance companies as to whether the use of ACM\nsheets in the cladding of Grenfell Tower failed to meet building regulations\nand was installed illegally and, as such, who is responsible for rectifying the\nissue for the hundreds of social housing buildings and countless private sector\nresidential buildings, hotels, hospitals and schools where this cladding has\nbeen used. It has also become apparent that a major reform of building safety\nregulations is needed. The comprehensive building safety regulations introduced\nin England and Wales in 1965 have been gradually amended over time to result in\nthe current performance-based system of regulations introduced in 1985 which\nare much more open to interpretation. &nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In response, the Government has taken a series of steps to strengthen\nbuilding safety and regulations. The Government\u2019s Ministry for Housing,\nCommunities and Local Government set up their <a href=\"https:\/\/www.gov.uk\/guidance\/building-safety-programme\">Building Safety Programme<\/a> to \u201cmake sure that\nresidents of high-rise buildings are safe \u2013 and feel safe \u2013 now and in the\nfuture\u201d which includes a large-scale project to identify both social sector and\nprivate buildings 18 metres high and above with unsafe cladding and carry out\nemergency restoration work. To date, costs have only been recovered from a\nlimited number of developers for private sector buildings and the government\nhas funded the replacement of unsafe ACM cladding on social sector buildings higher\nthan 18 metres.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The <a href=\"https:\/\/www.gov.uk\/government\/news\/explained-the-draft-building-safety-bill\">Building Safety Bill<\/a> was also announced\nin December 2019, alongside the intention to introduce a new <a href=\"https:\/\/www.hse.gov.uk\/building-safety\/index.htm\">Building Safety Regulator<\/a>. In terms of future\ndevelopment, on 21 December 2020, the Government\u2019s building regulations ban\ncame into effect for the use of combustible materials in the external walls of\nnew buildings and those currently under construction which are over 18 metres\nhigh. This applies to all new residential housing, residential care premises, hospitals,\nstudent accommodation and boarding school dormitories. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On 9 February 2021, a further \u00a33.5bn was also pledged by Housing Minister Robert Jenrick to fix the unsafe cladding on high rise buildings. As it stands, the government expects freeholders to pay to rectify cladding on buildings less than 18 metres high and a loan has been made available to allow said freeholders to borrow money to pay for these repairs at a low rate of interest, although this does not cover other prevalent defects which have been discovered such as missing firebreaks and faulty fire doors, or increased insurance premiums. Any costs passed on to leaseholders are due to be capped to a maximum of \u00a350 a month\/\u00a3600 year. A new developer levy and tax on profits for housebuilders have also been proposed to recoup the costs arising from the cladding issue, but this is yet to be finalised and will not come into force until 2022.  <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This has\neffectively left thousands of owners of medium to low rise properties less\nthan 18 metres high <a href=\"https:\/\/www.which.co.uk\/news\/2020\/08\/homeowners-face-sales-falling-through-and-zero-valuations-due-to-fire-safety-test-delays\/\">in limbo<\/a>, since they have\nbeen unable to sell their homes while they await clarification that their\nproperties meet fire safety regulations and that mortgage lenders and insurers\nwill provide loans and home insurance cover, something they have been unwilling\nto do even with the government\u2019s insistence that these properties are deemed\nlower risk. Despite an agreement between the government, RICS, UK Finance and\nthe Building Societies Association on 21 November 2020 to remove the need for\nan EWS1 form when selling or remortgaging, the impact on the property market\nhas already been seen, with flat sales down by around 40% in 2020. Many\nleaseholders and Help to Buy scheme participants have also been presented with extortionate\nrepair bills already to rectify an issue that they were completely unaware of\nwhen purchasing their property. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As such, many industry insiders, property owners and leaseholders are asking\nthe government to do more to assist <em>all<\/em> property owners and tenants\nwhose homes are affected by unsafe cladding, not just those whose developments\nare 18 metres high or more. There have also been calls for financial input from\nbuilding owners and developers more immediately, as opposed to the taxpayer\nhaving to foot the bill. Many MPs also feel the scheme should go further to\naddress <a href=\"https:\/\/www.theguardian.com\/society\/2021\/feb\/10\/jenrick-announces-billions-to-fix-cladding-on-high-rises\">additional fire related costs<\/a> and not just\ncladding. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Whilst there has been some suggestion that the criteria for financial assistance in resolving the cladding crisis and addressing current and future building safety issues could change since the draft Building Safety Bill was published on 20 July 2020, the <a href=\"https:\/\/publications.parliament.uk\/pa\/cm5801\/cmselect\/cmcomloc\/466\/46604.htm\">Bill<\/a> still needs to be considered by Parliament and is unlikely to come into force until late 2021 at the earliest.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, Minister of State Kit Malthouse has confirmed that the Government plan to consider the thorny issue of who should pay for the repairs via the Building Safety Bill when it is introduced in Spring 2021. His statement comes in the wake of the recent Commons vote on 24 February 2021 against amendment to the Fire Safety Bill to stop leaseholders being made to pay the costs for cladding remediation works.
