As everyone\nfrom first time buyers to seasoned house flippers will be aware, buying a new\nhouse will cost you so much more than just the price of the property. From solicitors\u2019\nfees<\/a> to house reports<\/a> and removal costs,\nthere are a number of additional fees to factor in, including stamp duty.<\/p>\n\n\n\n

Stamp Duty Land\nTax (to give the fee its official name) is a tax applicable to properties\npurchased in England and Northern Ireland and you can learn more about the\norigins and various rates payable at www.gov.uk\/stamp-duty-land-tax<\/a>.<\/p>\n\n\n\n

Those buying\nproperty in Scotland pay Land and\nBuildings Transaction Tax<\/a> and in Wales, Land Transaction Tax<\/a>.<\/p>\n\n\n\n

From 8 July\n2020 to 30 June 2021, the government introduced a temporary tax break on stamp\nduty for residential properties up to the first \u00a3500,000 and a break on the\nfirst \u00a3250,000 from 1 July \u2013 30 September 2021. These temporary tax breaks were\nintroduced to reinvigorate the UK housing market in the midst of the\ncoronavirus pandemic and the accompanying economic fallout and applied to both\nfirst time buyers and those who had bought houses before. However, buyers\npurchasing additional properties were subject to a 3% higher rate on stamp duty\nduring this period.<\/p>\n\n\n\n

This means that\nduring this time, there were buyers purchasing properties for less than\n\u00a3500,000 (and later \u00a3250,000) who did not need to pay any stamp duty at all.\nHence the sudden upturn in both property transactions \u2013 with an impressive 1.45\nmillion purchases agreed in 2021 \u2013 and house prices as a result.<\/p>\n\n\n\n

From 1 October\n2021 \u2013 22 September 2022, the usual rates of stamp duty were resumed, with tax\ndue on properties worth more than \u00a3125,000 or \u00a3150,000 for non-residential land\nand properties.<\/p>\n\n\n\n

On 23 September\n2022, the then Chancellor, Kwasi Kwarteng, announced that the threshold for\nstamp duty would be permanently lifted to \u00a3250,000 with immediate effect and to\n\u00a3425,000 for first time buyers. However, on 17 November 2022, the current Chancellor,\nJeremy Hunt, announced a deadline for the new tax threshold as part of his\nAutumn Statement to parliament. The new nil-rates for both existing and\nfirst-time buyers will remain in place until 31 March 2025, when they will\nreturn to the usual rates below.<\/p>\n\n\n\n

Whilst there\nhave been calls for a more permanent overhaul to stamp duty arrangements in\nfuture \u2013 including the pre-pandemic suggestion that the government had plans\nfor property vendors to assume responsibility for paying stamp duty \u2013 responsibility\nto pay the tax still sits very squarely with the buyer. This is unlikely to\nchange any time soon, making stamp duty a necessary evil for today\u2019s\nhomebuyers.<\/p>\n\n\n\n

So, at what\npoint in your property purchase do you actually need to pay the stamp duty tax?<\/p>\n\n\n\n

Unlike the vast\nmajority of fees associated with buying a house, the payment of stamp duty\ntakes place after the sale is completed. Buyers have 14 days after completion\nof the property purchase to file a return to HMRC and pay the stamp duty that\nis due.<\/p>\n\n\n\n

However, in\nmost cases, the buyer\u2019s solicitor or conveyancer will calculate the stamp duty\nowed and pay the bill on your behalf. So, in reality, you still need to have\nthe money set aside and ready to transfer to your solicitor with the balance of\nfunds before the sale is completed (minus any deposit which has already been\npaid at exchange). Solicitors will usually require the money to have cleared no\nlater than the day before you are due to complete on the sale, but some\nsolicitors may request payment before this date so make sure you have clarified\nthe fee deadline with your specific solicitor in advance.<\/p>\n\n\n
