Estate agents and industry insiders the length and breadth of the country have been calling for a stamp duty holiday to help kick-start the housing market following its Covid-19 shutdown. <\/p>\n\n\n\n

Indeed, during the period of lockdown, Zoopla\u2019s Cities House Price Index showed a whopping 90 per cent decline in market activity. <\/p>\n\n\n\n

Social distancing restrictions were relaxed sufficiently from 13 May to allow for onsite viewings and valuations, and as a consequence a steady stream of properties started to appear on the market once again, alongside an encouraging number<\/a> of property transactions. However, many suggest that the way to maintain this bounce-back is to introduce a stamp duty holiday.<\/p>\n\n\n\n

It is also worth\nremembering that the property market has a major knock-on effect for other\nareas of the economy including construction, home furnishings, DIY, utility\ncompanies and even the UK government itself (which netted \u00a38.4 billion through\nthe sales of residential properties in the 2018-19 tax year), so the impact of\npeaks and troughs in sales are not restricted to the property industry alone. <\/p>\n\n\n\n

But what is stamp duty and\nwhat are the implications of a stamp duty \u2018holiday\u2019? <\/p>\n\n\n\n

What is stamp duty?<\/strong><\/h3>\n\n\n\n

Stamp Duty Land Tax<\/a> (SDLT) is a tax applicable to properties\npurchased in England and Northern Ireland which are worth more than \u00a3125,000\n(or \u00a3150,000 for non-residential\nland and properties). Those buying property in Scotland pay Land and Buildings Transaction Tax<\/a> and in Wales, Land Transaction Tax<\/a> if the sale was completed on or after 1\nApril 2018.<\/p>\n\n\n\n

The idea of stamp duty\nisn\u2019t new, and dates back to 1694 when King William III and Queen Mary II\nintroduced the transaction tax as a way to raise funds for their war with\nFrance. However, up until 1997 the fee was a flat 1% on any property over\n\u00a360,000. Enter Gordon Brown\u2019s \u201csliding slab structure\u201d whereby bands with\nhigher stamp duty payments were set depending on the price of the property.\nThresholds were tweaked further in the intervening years as house prices began\nto rise dramatically, before George Osborne introduced progressive fees in\nDecember 2014, with a steep increase for properties costing more than \u00a3925,000.\n <\/p>\n\n\n\n

Rates do vary<\/a>. For instance, first time buyers (or those buying a property jointly with a first-time buyer) are subject to a discount on stamp duty and amounts also vary depending on whether the property is residential or mixed-use. Shared ownership properties are subject to stamp duty on the total amount the property is worth, rather than the percentage you buy, however any increase in the percentage you own is not subject to further stamp duty payments. Since April 2016, any property which is not used as a primary residence has also been subject to an extra 3% charge (5% as of 1 April 2025) in an effort to increase the affordable housing budget.<\/p>\n\n\n\n

Currently, it is the\nresponsibility of the buyer to pay the tax, however prior to the Covid-19\npandemic in 2019, there was speculation that the then Chancellor, Sajid Javid,\nwould be announcing a complete change to stamp duty arrangements whereby the seller assumed responsibility<\/a> for paying the stamp duty. <\/p>\n\n\n\n

What would a stamp duty\nholiday look like and what are the implications?<\/strong><\/h3>\n\n\n\n

Whilst there will always\nbe a market for bricks and mortar investment, the impact of the Covid-19\npandemic has seen many industry insiders suggest a crisis in the housing and\nconstruction industry similar to the fallout from the 2008 financial crisis. <\/p>\n\n\n\n

And whilst this latest blow to the housing market is health rather than finance related, a slump in house prices has been predicted since potential buyers affected by the financial impact of Covid-19 are likely to be overly cautious, unable to afford the same properties they would have considered pre-pandemic or may even struggle to get a mortgage approved in the first place.<\/p>\n\n\n\n

The argument to remove\nstamp duty for a fixed time from industry insiders such as RICS<\/a>, the Home Builders Federation and\nRightmove suggests buyers will be more likely to purchase a new house and\ntherefore increase the number of house sales (a figure of over 500,000 sales\nlost for 2020 was touted at the height of lockdown) and consequently, house\nprices. There would also be a much-needed boost in confidence for developers\nplanning new homes. <\/p>\n\n\n\n

Whilst the 15 month stamp\nduty holiday introduced in September 2008 in the wake of the financial crisis\ndid see an 8% increase<\/a> in transactions, the holiday was very\nspecific in supporting the lower end of the property market only, applying to\nproperties priced at \u00a3175,000 or less. <\/p>\n\n\n\n

The house buying game is a\nprotracted one, with the time lag from initial viewings to completion (and\ntherefore payment of stamp duty) often taking months. At the same time, any\nfuture stamp duty holiday could not last indefinitely. Would sales therefore\nneed to be completed within a set time period as per 2008-09? And would the\nstamp duty holiday be applicable just to first time buyers or for those buying\nproperties within a certain price bracket? What about second homes, buy-to-let\nproperties or international buyers? A stamp duty holiday is not quite as\nstraightforward a tax break as it may initially appear.<\/p>\n\n\n\n

And this is where a\ngovernment already under the strain of business relief costs offered during the\npandemic will need to really consider which buyers need to see the benefit of\nany such tax relief, how long this could conceivably be supported or if such\nrelief is actually necessary depending on how well and how quickly the property\nmarket bounces back<\/a>.   <\/p>\n\n\n\n

As such, and with no\ndefinitive word from the government either way to date, it is highly likely\nthat a wait and see approach will be adopted, and it is unlikely that we will\nsee any change to current stamp duty arrangements until at least the Autumn\nstatement, or even the March 2021 Budget.   <\/p>\n\n\n\n

With the Northern Ireland housing market only open for business again on\n15 June and restrictions still in place for the property markets in Wales and\nScotland, only time will tell on the impact for the UK as a whole. <\/p>\n\n\n
